Subsequent convictions of a prosecution witness cannot be used as fresh evidence to prove the underlying facts of those convictions by virtue of s 91 of the Evidence Act 1995 (NSW). Where such convictions are admissible only as to credibility generally, and the jury was already aware of the witness's extensive prior convictions, the additional convictions are unlikely to meet the threshold for fresh evidence warranting leave to appeal.
