Where the Crown case on a critical element depends entirely on the evidence of witnesses whose credibility has been substantially impugned — including by prior appellate findings — and whose evidence is uncorroborated and unrecorded, the verdict may be unreasonable even making full allowance for the jury's advantages. Prior adverse credibility findings by an appellate court about a Crown witness do not, however, create a miscarriage of justice when that witness is called in a different case involving different admissions.
