A member of a criminal gang in possession of a loaded, concealed, defaced prohibited firearm while subject to a firearms prohibition order commits an offence above mid-range objective seriousness under s 7(1) of the Firearms Act 1996 (NSW), even absent a finding that the firearm was connected to drug supply. Being subject to an FPO, while not separately charged, renders the s 7(1) offence significantly more objectively serious. Possession for personal protection is not a matter of significant, if any, mitigation.
