Post-sentence COVID-19 pandemic restrictions rendering prison conditions more onerous are not a basis for appellate intervention with a sentence. Such matters remain exclusively for the executive government. While sentencing judges may take prospective pandemic impacts into account at first instance, the appellate court will not receive fresh evidence of society-wide impacts on custody conditions occurring after sentencing.
