In a short trial with simple credibility issues, a summing-up that does not extensively summarise the defence case will not occasion a miscarriage of justice where the jury could not have been under any misapprehension as to the defence case. The requirement of fairness does not oblige the trial judge to put every argument advanced by defence counsel to the jury; the extent of judicial comment required depends on the length, complexity and nature of the trial.
