Delay between offending and charging is a relevant sentencing consideration for federal offenders under s 16A of the Crimes Act 1914 (Cth), even though delay is not specifically listed in s 16A(2), because the opening words 'in addition to any other matters' accommodate general common law sentencing principles. However, the weight to be given to delay depends on its consequences for the offender; absence of offending during the delay period is relevant primarily to prospects of rehabilitation. Cooperation with law enforcement under s 16A(2)(h) does not in every case require a separately quantified percentage discount; it may be taken into account as part of the general mix of mitigating factors.
