Where a sentencing judge indicates a proposed sentence and defence counsel declines to make submissions after conferring with the client, competing inferences are available (incompetence or informed acceptance), and the applicant bears the burden of adducing evidence to resolve the ambiguity. Without evidence from the applicant or former counsel explaining the approach taken, a breach of procedural fairness will not be established on the face of the transcript alone.
