The future deportation of an offender cannot be regarded as rendering imprisonment more burdensome on account of separation from children, where that separation is an inevitable consequence of the detection of offences and the consequential imprisonment. Speculative possibilities of a future reunion rendered unachievable by deportation are not to be taken into account in mitigation of sentence. An effective sentence of ten years' imprisonment with an eight-year non-parole period for maintaining a sexual relationship with a child, where the offender actively participated in sexual abuse by a co-offender and recorded offending, is within the permissible range.
