A factual error in a prosecution opening address that is not repeated during the trial, and where the jury is clearly directed that counsel's addresses are not evidence, and where the correct version is available in evidence tendered to the jury, will not ordinarily give rise to a substantial miscarriage of justice. An error in sentencing remarks that is not taken into account as an aggravating factor will not ordinarily provide a basis for a successful sentence appeal.
