An application for extension of time to seek leave to appeal will be refused as futile where the proposed appeal is totally without merit within the meaning of s 14D(3) of the Supreme Court Act 1986 (Vic). A party who has already unsuccessfully sought to set aside a consent order and settlement cannot agitate the same matter a second time by seeking leave to appeal from the consent order.
