Where a causal finding relevant to apportionment between concurrent wrongdoers is set aside on appeal, and all other relevant facts have been found by the tribunal below, the Court of Appeal may perform the reapportionment itself rather than remitting, particularly where remittal would cause significant additional costs and delay. The reapportionment must be performed afresh having due regard to the tribunal's findings, not by mathematical rectification of the original percentages.
