An application for leave to appeal that seeks to disturb orders between other parties who do not seek to challenge those orders is totally without merit, and failure to accept a Calderbank offer to discontinue such an application on a walk-away basis will be treated as unreasonable, attracting indemnity costs. Where a partially successful appellant's success is enjoyed wholly against one respondent consultant, a proportionate costs order against that respondent is appropriate.
