A proceeding is not a 'test case' warranting departure from the usual costs rule merely because it raises novel legal issues of general importance, where the proceeding was brought to further the parties' private interests rather than in the public interest. Even if a proceeding could be described as a test case, there is no rule requiring costs to be exercised in any particular way.
