Post-entry conduct during an aggravated burglary, including confrontation with occupants, may be taken into account in assessing the objective gravity of the offence, provided that where such conduct constitutes a separate charged offence, the sentence for that offence is served concurrently to avoid double punishment. For young offenders assessed as suitable for a Youth Justice Centre Order, a sentencing judge's failure to give adequate weight to youth, immaturity, vulnerability in adult prison, and rehabilitation prospects may constitute appealable error.
