A party who is given a sufficient opportunity to prepare and present its case but does not take advantage of it cannot complain of a denial of procedural fairness when the court declines to provide a further opportunity. In summary judgment applications by mortgagees, the mortgagor must identify at least a hint of a defence to resist the application; bare assertions of a defence without any particulars are insufficient. Allegations of bias cannot be sustained merely by pointing to adverse discretionary decisions or the rejection of unmeritorious submissions.
