The decision consolidates the aggravating factors for unauthorised possession of a firearm in the ACT, drawing from multiple authorities to identify eight specific factors: number of firearms, nature and type, capacity to discharge, concealability, location and security, length of possession, circumstances of acquisition, and reason for possession. The decision also applies the Drug and Alcohol Treatment Order framework under s 12A of the Crimes (Sentencing) Act 2005 (ACT) to an offender with a significant criminal history and drug dependence. Prior offending cannot justify a sentence greater than that appropriate to the current offence and cannot justify preventive detention.
