A serious heart condition (non-ischaemic cardiomyopathy with approximately 25% heart function) does not preclude imprisonment where the court is satisfied that correctional facilities have adequate medical resources. Theft from a vulnerable elderly victim is reprehensible and warrants imprisonment notwithstanding the offender's difficult personal history, where previous non-custodial orders have failed. A very late guilty plea attracts a discount of 15 per cent.
