The loss of a front tooth caused by a punch to the face is capable of constituting 'grievous bodily harm' within the meaning of s 35(1)(b) of the Crimes Act 1900 (NSW), on the basis that it amounts to serious disfigurement, even where the injury did not require operative treatment and was managed conservatively. An indicative sentence that exceeds the jurisdictional maximum applicable at the time of offending is an error requiring the exercise of the sentencing discretion afresh, though the court is not required to resentence where the same or greater aggregate sentence is appropriate.
