The Court of Criminal Appeal cannot intervene to reduce a sentence on the basis that COVID-19 has rendered prison conditions more onerous where the offender was sentenced before the onset of the pandemic. Where defence counsel acquiesces to a sentencing judge's proposed approach at first instance, the Court will be reluctant to entertain arguments on appeal seeking to resile from that concession absent a demonstrated miscarriage of justice.
