For aggravated sexual penetration without consent of a child under 16 (s 326 Criminal Code (WA)), where there has been no plea of guilty, sentences of around 5-6 years' imprisonment may be expected, but sentences well beyond that range may be justified by the circumstances. A sentence of 7 years 8 months was upheld where the offending involved a high degree of criminality and there were no mitigating circumstances.
