Where a trial judge directs the jury on an alternative mental element pathway not relied upon by the Crown in a sexual assault trial, no miscarriage of justice arises if the accused's case at trial was conducted on a basis inconsistent with the accused holding the relevant belief. The tactical disadvantage must be assessed by reference to whether the jury could reasonably have convicted on the impugned basis given the way the defence case was actually run.
