Where co-offenders are sentenced on separate agreed facts containing materially different descriptions of each other's roles, the comparison for parity purposes must be between the culpability shown in each offender's own agreed facts — it is erroneous to compare the offender's role in his facts with the co-offender's role as described in those same facts. Parity must be incorporated into the instinctive synthesis, not applied as a separate reduction after the sentence is determined. A Crown appeal may be dismissed despite established error and manifest inadequacy where the respondent has been released and is demonstrating rehabilitation progress.
