The parity principle applies when co-offenders are sentenced in different courts, including where some are dealt with summarily in the Local Court and others in the District Court. The sentencing principles are the same in both courts and the jurisdictional limit of the Local Court does not affect the application of parity. Failure of defence counsel to raise parity at first instance does not preclude the point being raised on appeal. Prosecutors have a duty to place all relevant co-offender sentencing material before the sentencing judge.
