A sentencing judge need not use the statutory language or the term 'indicative sentences' when complying with s 53A(2)(b), provided the remarks on sentence as a whole demonstrate that the discount was applied to the indicative sentences. When reverse-engineering a notional undiscounted aggregate sentence for comparison purposes, the resulting figure is only a 'rough guide' and must be approached with caution. The production of bare sentencing statistics without information about discounts, offence circumstances, and subjective factors provides no proper basis for concluding that a sentence is outside the available range.
