Where a sentencing judge finds a connection between an offender's mental conditions and their offending, the judge must consider the effect of that finding on moral culpability and the weight to be given to general deterrence, and must give reasons if declining to give effect to that connection. A bare assertion that the connection does not play 'any real part' in moral culpability, without supporting reasoning, constitutes House v The King error. Additionally, the weight of LSD in individual tabs cannot be inferred from the statutory definition of 'discrete dosage unit' without evidence.
