A sentencing judge who finds on the evidence that an offender suffers from mental health conditions that contributed to the offending must engage with the DPP v De La Rosa principles concerning moral culpability and general deterrence, and explain why they do or do not apply; failure to do so constitutes material error warranting resentencing.
