The term 'disciplinary action' in s 11(1)(g) of the Legal Profession Act 2006 (NT) encompasses a formal disciplinary process including adverse findings, not merely the final sanction imposed. The duty of candour is continuous and requires disclosure of any matter that might reasonably be considered to bring a practitioner within a suitability matter or otherwise bear adversely on fitness, regardless of whether the practitioner disputes the underlying allegations. In non-disclosure cases, the court need not determine the truth of the undisclosed allegations; the relevant question is whether the allegations or findings should have been disclosed.
