An appeal from orders refusing to stay committal proceedings becomes inutile once the committal hearing has occurred and committal orders have been made. An oral application to amend a notice of appeal to fundamentally change the nature of the appeal (from an appeal against interlocutory orders to an appeal from Magistrates Court committal orders) will be refused where the appropriate course is to file a separate notice of appeal. The Court of Appeal expressed strong doubt as to whether it has jurisdiction to hear appeals from Magistrates Court committal orders.
