For rape offences involving significant violence on a plea of guilty, the sentencing range is 10 to 14 years' imprisonment. Youth and lack of prior criminal history support sentencing at the lower end of this range. Courts should not rigidly compartmentalise rape offences by type of penetration when comparing sentences; all circumstances of the offending must be considered. Where the serious violent offence provisions require service of 80% of the sentence, this must be factored into the assessment of totality and the allowance for a guilty plea.
