Where a second criminal appeal raises issues about the conduct of Victoria Police and a solicitor-informer, and the Chief Commissioner claims PII over a large volume of documents, the applicant's legal representatives may be permitted to inspect the documents on a confidentiality undertaking to act as contradictor. A pre-trial PII ruling does not preclude reconsideration on appeal where the issues are different from those at trial.
