An appeal from a judicial registrar's determination in a criminal matter referred under r 84.03 of the Supreme Court (General Civil Procedure) Rules 2015 is governed by r 84.05 of those Rules, not s 113M(4) of the Supreme Court Act 1986. A s 317 application for production of documents will be refused where the proposed ground of appeal to which the documents relate lacks merit, or where the documents are sought in the absence of any proposed ground of appeal to which they relate.
