A party who is aware that a tribunal hearing is proceeding and who has the ability to attend (including by telephone) or to send a representative, but who elects not to do so, is not denied procedural fairness by the tribunal proceeding in their absence. A conflicting engagement that is capable of being rescheduled does not constitute a reasonable basis for an adjournment, particularly where the tribunal hearing is conducted by telephone.
