A contractor's voluntary assistance with tasks outside the scope of a cartage or services agreement does not convert those tasks into contractual obligations, and conduct during such voluntary tasks cannot ground a right of summary termination for breach. Wide general words of release in a deed of termination will be confined to the specific subject matter of the deed, applying the Grant v John Grant & Sons principles, and where the deed relates to a short-term post-termination arrangement, the release does not extend to claims arising from the principal contract. The mere existence of a right to terminate on notice does not cap damages for wrongful termination; the party asserting hypothetical termination bears the burden of proving it would have exercised that right.
