A sentence of 2 years and 6 months' imprisonment for dangerous driving causing death by a truck driver who was fatigued and drug-affected was manifestly inadequate where the offending was assessed as not at or toward the lower end of seriousness and moral culpability was not low. Delay of over four years between offending and plea hearing, even where not attributable to the offender, does not of itself give a case a unique quality warranting exercise of the residual discretion on a Crown appeal. There is no arithmetical yardstick derivable from other cases for quantifying the sentencing discount for delay.
