A single-date trafficking charge does not preclude a sentencing judge from finding the offender was engaged in a continuing business of drug dealing, provided the finding is supported by surrounding circumstances such as cash, firearms, and admissions, and does not breach the De Simoni principle; however, where those same surrounding circumstances also ground separate charges, cumulation must reflect the degree of factual overlap to avoid manifest excess.
