A 500% difference in head sentences and 733% difference in non-parole periods between co-offenders sentenced for the same offence of kidnapping was held to be excessive and productive of a justifiable sense of grievance, even where the appellant was the instigator and organiser and the co-offender played a lesser role. A serious post-sentence injury suffered in custody (loss of sight in one eye) was taken into account on resentencing as rendering the experience of custody significantly more onerous.
