Quick Take

The waste levy exemption in reg 5(1)(i) of the Waste Avoidance and Resource Recovery Levy Regulations 2008 (WA) applies only to the estimated volume of asbestos containing material within a mixture, not to the whole volume of a mixture of asbestos containing material and other material (such as soil and sand) that it is not reasonably practicable to separate. Operators of licensed landfills receiving mixed loads containing asbestos must estimate and claim exemption only for the asbestos containing material component.
