In a single-complainant sexual assault trial involving multiple counts, acquittals on some counts are rationally explicable by reference to doubt about specific elements (such as whether penetration occurred for cunnilingus, or whether the accused appreciated lack of consent in the early stages of an encounter) without implying doubt about the complainant's overall credibility. A direction on intoxication that instructs the jury to assess the accused 'as he was on the night' is adequate without requiring a more elaborate direction on the relationship between intoxication and each form of recklessness, particularly where the more detailed direction was not sought at trial and would not have assisted the accused.
