In a wholly circumstantial murder case tried by judge alone, errors in the trial judge's use of lies as consciousness of guilt evidence will not give rise to a substantial miscarriage of justice where the applicant's statements are largely superfluous to the Crown's circumstantial case and the Crown case is otherwise proved beyond reasonable doubt on the admissible evidence.
