When co-offenders are charged with different offences, parity comparisons based on the percentage each sentence represents of the applicable maximum penalty are artificial and favour form over substance. The focus must remain on the substance of the sentences imposed, including the total effective sentence, rather than arithmetical proportions of individual sentences or cumulation orders.
