Where a sentencing judge misstates the maximum penalty for an offence, the error will not vitiate the sentencing discretion if the sentence imposed represents only a very small fraction of the misapprehended maximum (here, 1.2 percent). A sentencing judge is not required to address stress and anxiety from delay where no such submission was made at the plea hearing.
