Where an accused's account in a record of interview amounts to a bare denial of offending conduct without presenting a reasonably plausible alternative version of events, the Magistrate's acceptance of the prosecution case necessarily involves rejection of the accused's account, and there is no requirement for the Magistrate to expressly articulate that rejection as a separate step in applying the Liberato direction. Proof of an assault offence does not require the victim to identify with precision the exact nature of the blow received.
