The offence of fraud under s 192E(1)(b) of the Crimes Act 1900 (NSW) does not require proof that the accused intended to cause, or was reckless as to causing, the financial disadvantage; the mental elements embedded in 'deception' (s 192B) and 'dishonestly' (s 4B), together with the causal connection requirement, are sufficient.
