A breach of the Crown's disclosure obligation under s 590AB of the Criminal Code (Qld) that could realistically have affected the jury's assessment of a complainant's credit satisfies the materiality threshold for miscarriage of justice established in Brawn v The King, and the proviso cannot cure such a breach where the non-disclosure might have influenced the result.
