Irregularities in a Magistrates Court sentencing process (such as failure to invite submissions) will not warrant leave to appeal to the Court of Appeal where the District Court has found the irregularities immaterial and would have imposed the same sentence, particularly where probation and prohibition orders have expired and no convictions were recorded.
