An applicant for family provision must disclose to the Court as fully and as frankly as possible all details of his or her financial and material circumstances, including those of a spouse and household members. Failure to do so, while not necessarily fatal to the application, will cause difficulty in the assessment of quantum. A wise and just testator is not taken to have foreseen that an applicant would withdraw and spend all superannuation after the testator's death.
