Compliance with the s 708 exemption from fundraising disclosure requirements under ch 6D of the Corporations Act 2001 (Cth) does not provide a defence to a charge of dishonest conduct under s 1041G in ch 7, as the two chapters deal with different subject matters and the fundraising provisions do not exhaustively define the circumstances in which conduct may be dishonest in the financial services context.
