Questions referred for a s 319A reference determination should be focused and relevant to the proposed ground of appeal, avoiding open-ended inquiries, speculative formulations, and questions incapable of assisting in the resolution of the appeal; however, questions may be included where material obtained in relation to one party gives rise to a reasonable inference that similar conduct may have occurred involving another party, even absent specific allegations of wrongdoing.
