Where a client collates pre-existing unprivileged notes into a bundle for provision to lawyers, the bundle may attract client legal privilege as a confidential communication reflecting the client's assessment of relevance, but discovery of a redacted version of that bundle in other proceedings will waive privilege over the entire document because the confidentiality the privilege protects — the selection and assessment — has been disclosed.
