Where an offender's intellectual disability, cognitive deficits and risk of institutionalisation are relied upon in mitigation for family violence offending, these factors cannot be permitted to 'swamp' the sentencing purposes of deterrence, denunciation and community protection, particularly where the offender has an extensive criminal history and very high risk of reoffending.
